2. Use of the Site & Access Restrictions

• We may suspend, restrict access, or remove parts or all of the Site at our discretion.
• You are responsible for ensuring your device can access the Site and for any fees associated (internet, data, etc.).
• If you register for an account, you must provide accurate, current information. You are responsible for keeping your credentials (username/password) confidential and for all activity under your account.
• If we suspect misuse or breach, we can disable your account or access without notice.

3. Intellectual Property / Copyright

• All content on the Site — text, images, illustrations, designs, audio, software, page layouts — is the property of Mugafi or its licensors.
• Except for downloading or printing a single copy for your personal, non-commercial use, you may not reproduce, distribute, modify, publicly display, or create derivative works from the content without our express permission.
• Any unauthorized usage may result in immediate termination of access.

4. Trademarks

"Moksh", the Moksh logo, character names, designs, slogans, and other associated assets are trademarks of Mugafi or its affiliates. You may not use these marks without our prior written permission.

5. Prohibited Conduct

You must not use the Site to:

• Violate any laws or regulations
• Infringe others' intellectual property or privacy rights
• Upload malware, viruses, or harmful code
• Attempt to gain unauthorized access to the Site, servers, or accounts
• Introduce excessive traffic or overload the Site
• Use automated systems (bots, scrapers) to access or copy content
• Engage in spam, chain letters, or promotional solicitations
• Misrepresent yourself or the origin of content

6. Purchases, NFT / Digital Ownership & Transactions

• All purchases, pledges, and deliveries through the Site or linked services are subject to additional terms ("Terms of Sale") which are incorporated into these Terms.
• Where applicable, and if stretch goals unlock them, you may obtain digital collectible character ownership (e.g. NFT). Ownership/contracts are governed by separate smart contract terms and cannot be fully revoked; however, your rights and royalties will be subject to the associated blockchain rules.
• Refunds, payments, and delivery are handled by third-party payment processors, shipping providers, or blockchain platforms. These providers may have additional terms you must accept.

7. Disclaimers & No Warranties

• The Site and all content are provided "as is" and "as available".
• We disclaim all warranties — express, implied, statutory — including warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation.
• We do not guarantee the Site will be safe, secure, error-free, or virus-free.
• Any reliance on information in the Site is at your own risk.

8. Limitation of Liability

To the maximum extent permitted by law, Mugafi and its affiliates shall not be liable for any indirect, exemplary, incidental, special, punitive, or consequential damages arising from your use (or inability to use) the Site, even if we were advised of the possibility of such damages. This includes loss of data, lost profits, business interruption, or harm to reputation.

9. Indemnification

You agree to indemnify, defend, and hold harmless Mugafi and its officers, directors, employees, agents, licensors, and affiliates from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the Site or your breach of these Terms.

10. Governing Law & Disputes

• These Terms are governed by the internal laws of the jurisdiction where Mugafi is registered (to be specified).
• Disputes shall be resolved exclusively in the courts in that jurisdiction, unless otherwise required by law.
• You agree to waive objections to jurisdiction or venue in those courts.

11. Severability & Waiver

• If a portion of these Terms is deemed invalid or unenforceable, the remaining sections remain in full force.
• Our failure to enforce any right or provision doesn't waive our right to enforce it later.

12. Entire Agreement

These Terms, the Privacy Policy, and Terms of Sale constitute the full agreement between you and Mugafi regarding your use of the Site. They supersede all prior agreements and understandings (oral or written).
